Former PNG PM O'Neill files Criminal Complaint against Police Minister Bryan Kramer for forgery

Former Papua New Guinea Prime Minister Peter O'Neill has lodged a Criminal Complaint  against Police Minister Hon. Bryan Kramer for forging and falsifying the defective arrest warrant against former Prime Minister, Hon. Peter O’Neill.

Principal of Niuage Lawyers, Mr. George Lau, who was lawyer that filed documents for the judicial review of the defective arrest warrant lodged the complaint with the RPNGC Metropolitan superintendent today.

The complaint seeks a full criminal investigation into the actions of Mr. Kramer on allegations of forging an official police warrant which is chargeable under Official Corruption Section 87 of the Criminal Code Act and Forgery under Section 462 Criminal Code Act, and further for defamation under Section 21 (2) of the Cyber Crime Code Act.







































Mr. O’Neill said the affidavit filed by Detective Senior Constable of the NCD Fraud Squad, Kila Tari, to support his withdrawal of the arrest warrant stated that the arrest warrant was defective. The reason being that the warrant did not have any of three prescribed reasons for effecting a warrant for arrest articulated.” (See attached Annex A page 6 in the attached Affidavit)

“Detective Senior Constable Tari attached a copy of the arrest warrant to this affidavit that did not have a single category for effecting the warrant marked and articulated.

“On this basis the RPNGC the warrant was withdrawn.

“However, the warrant that Mr. Kramer posted in various online forums, including Facebook had been forged to include one of the category boxes being marked and this is where the forgery has occurred.

“Mr. Kramer is so desperate to misuse police powers that he has presented a fake police document.

“He so blinded by his power that he is blatantly announcing to the country that he is directing police operations.
“This intervention by a police minister into police operations is unconstitutional and highly illegal and amounts to official corruption.

“It is also of great importance that the Ombudsman Commission urgently review this matter on their own initiative.

“It is now incumbent upon the Acting Police Commissioner to properly and lawfully execute the authority of police and have this complaint fully investigated without further political interference.”

Mr. O’Neill made the point that even in his recent Facebook Posts, the Police Minister admits that he was being briefed on the police operation stating: ‘When I was briefed that Police were considering withdrawing the warrant, I raised the point that O'Neill's lawyers would simply try review the District Court's decision to withdraw the warrant - which is exactly what they did.’ (Bryan Kramer Facebook page, November 10 at 5:54 PM - https://www.facebook.com/bryan.kramer.90/posts/2335553993363979)

“This briefing to a Police Minister on police operations and his review of operational documents is entirely illegal and if the Prime Minister does not discipline his Police Minister we can only assume this is being done with the Prime minister’s approval.”

It is further understood that the Police Minister has directed police to arrest Mr. Lau when all the lawyer has done is file court documents.

“It is disgraceful that the Police Minister is again attempting to pervert the course of justice and use his police against a lawyer doing their job.

“It is imperative that he Acting Commissioner for Police put aside his political ambition and see to it that this abuse of power by the Police Minister is fully investigated without fear, favour or malice.

“There must be an investigation into the falsification of the warrant that was issued and collected by Kila Tali, and who has altered a District Court order that actually amounts to contempt of court as well as a criminal offence.

“This is what happens when Ministers interfere illegally in police work for political reasons and get themselves involved in lies and fake documents.”

Background:

The officer Detective Senior Constable Kila Tali who obtained the arrest warrant filed and moved on 28 October 2019 a Notice of Motion with a supporting affidavit to withdraw the arrest warrant (see below), and the District Court granted the withdrawal of the arrest warrant on that application on the same day.

In the affidavit Detective Senior Constable states:-

• That he applied for and obtained an arrest Warrant for Peter O’Neill and attached a true copy at annexure “A” in which no boxes were ticked;
• That O’Neill’s lawyers applied for a stay on the arrest warrant on the basis of three errors in the warrant, one being that no boxes were ticked;
• That the stay and injunction on the arrest warrant was granted by the court for these three reasons, including the fact that no boxes were ticked;
• That because of the stay and in the injunction and because of the three reasons why the arrest warrant is claimed to be defective (including that no boxes were ticked) he wishes to withdraw the arrest warrant;

The arrest warrant the actual police officer Kila Tali annexed to his affidavit has no boxes ticked. Kila Tali swears this is a true copy of the arrest warrant. He even notes there are no boxes ticked.
