KULUNGA'S APPLICATION DISMISSED

Supreme Court dismisses Kulunga's Application.

THE Supreme Court has dismissed Police Commissioner Toami Kulunga’s application to stop the National Court from handing down his sentencing for contempt.

This means the National Court decision to sentence Kulunga will be delivered on Friday as scheduled.

Chief Justice Sir Salamo Injia today said for justice to prevail, his opinion was to allow the National Court to continue with the matter first.

Kulunga was found guilty of contempt last month, when he failed to comply with National Court orders to reinstate Geoffrey Vaki as Assistant Commissioner in 2012.

Meanwhile Vaki’s lawyer Sam Bonner and the Principal of the law firm representing Kulunga in the National Court, Margaret Parua have been summoned to appear in court tomorrow to explain how they placed some consent orders in the Chief Justice’s Chambers over the long weekend.

The Chief Justice warned Mr Bonner to appear in court tomorrow without excuse.

“Shall I remand you in custody to ensure your appearance tomorrow?” Sir Injia asked Mr Bonner in light of his (Mr Bonners) attitude of absenteeism.

Ms Parua has been summoned because her signature was on the draft consent order said to have been pushed under the Chief Justice’s Chamber door.

Sir Injia says he wants an explanation on how the consent orders were framed whilst the matter was pending decision from the National Court.

It is understood that their action could amount to contempt.
