Fraud Director Matthew Damaru is expected to file for contempt of court charges against the police commissioner.
The Lawyers representing Damaru have prepared the charges and will file at the court registry.
A judge last week also instructed Commissioner Gari Baki's lawyer to explain to him reasons for setting up an inquiry into operations of the National Fraud and Anti-Corruption Directorate.
This relates to Commissioner Gari Baki suspending the National Fraud and Anti-Corruption Directorate a week ago.
His actions came after the court issued a temporary stop on the suspension of Mr .Damaru and for the court to deliberate on the matter.
Mr Baki claimed the action of the court had interfered with administrative work of an officer who was suspended on disciplinary actions.
Baki further proceeded to investigate the Fraud Office through and inquiry.
A public statement was made in the newspaper with terms of references.
A team of officers led by Assistant Commissioner Operations David Manning will lead the inquiry.
Meantime, Justice Colin Makail has summoned Commissioner Baki in court by Wednesday why he is conducting the inquiry.
Judge Makail said last week, the last ting he wants is for different authorities to resolve the same issue.
