High Court dismisses prosecutors application

A 3 men Supreme Court bench dismissed an application by the Public Prosecutor Pondros Kaluwin seeking to dismiss a special reference by plaintiff and Vanimo Green MP Belden Namah at the Supreme Court.
The application by Mr. Kaluwin was filed this week on grounds of abuse of process in the National Court.
Justice David Cannings in handing down the decision by the Supreme Court bench comprising Justice Allen David and Justice Hitelai Polume –Kiele said the application by the Public Prosecutor was incompetent and not properly before the court and none of the 5 grounds put forward dismissing the reference were meritorious.
The court was satisfied that the reference by Mr. Namah was properly before it and that it is obliged to determine the reference and thus refused the application to dismiss it and it ordered that it would hear the reference.
The questions to be tried in the Supreme Court relate to the Chief Justice Sir Salamoa Injia in appointing the tribunal against Mr. Namah when one of the 10 allegations against him relates to the judiciary. PNGFM / PNG Today
