Court declines former PNG PM O'Neill's Application, issues new Order
The National Court late Wednesday declined the application by former Papua New Guinea prime minister and Ialibu Pangia MP Peter O'Neill for an injunction stopping his arrest or attempted arrest.
Deputy Chief Justice Ambeng Kandakasi declined the application as a matter of law in that civil proceedings, in this case the defamation suit Mr O'Neill has filed against Police Minister Bryan Kramer, cannot be used to stop police from doing their work.
Justice Kandakasi said the fear of arrest is all speculation at this stage because there are no specifics on what the charge or charges are unless Mr O'Neill presents himself to be interviewed.
Having said that, the senior judge is however satisfied with evidence before the court that Police Minister Bryan Kramer is interfering with the operational work of police.
He's asked the lawyers to return to court today to assist as to what kind of particular orders to issue so that the demarcation between the Police Minister and Police Commissioner is clearer and is in line with the 1982 Supreme Court's interpretation of the law on the powers of the police minister.
Justice Kandakasi said the orders will ensure the Police Minister does not interfere with police work and also to avoid the continuing character assassinations on social media.
