PNG's Kiriwina-Goodenough MP Tomuriesas appears in Court

The Member for Papua New Guinea's Kiriwina Goodenough Douglas Tomuriesa and his wife Rachel Tomuriesa appeared before the Waigani Committal Court this morning.

They were arrested and charged by the National Fraud and Anti-Corruption Directorate officers on the 28th of last month.

Mr Tomuriesa, 51 of Losuia village in the Kiriwina Goodenough District, Milne Bay Province, was charged with one count of Misappropriation of K6 million the property of State, one count of False Pretence and one count of Money Laundering.

Mrs Tomuriesa, 52 of Kolonoboi village, Namatanai District, New Ireland Province was charged with one count of Misappropriation of K2.6 million the property of State and one count of Money Laundering.

Their lawyer, Allan Baniyamai, told the court that he will be filing an application in the National Court, arguing the process was abused in that the charges were struck out by the court in late 2019 and after further police investigations, the two were re-arrested and charged again.

He referred to Section 37 Sub Section 8 of the Constitution which states no person who’s been tried and convicted or acquitted for an offence shall again be tried for that offence except upon the order of a superior court made in the course of appeal or review proceedings relating to the conviction or acquittal.

He told the court that he will also be seeking a stay order of the case in the committal court until the National Court deals with the application on abuse of process.

The cases have been adjourned to 16th April.
