PNG Deputy PM Highlights Importance of Law Creation Procedures

Papua New Guinea Deputy Prime Minister and Attorney General Davis Steven says the recent Supreme Court’s declaration on the invalidation and unconstitutionality of the Public Money Management Regularization Act 2017(PMMR) Act is a lesson that those in the government must take into consideration when creating laws.


The Public Money Management Regularization Act was enacted by Parliament in 2017 with the primary aim to regularize the handling and management of public money received by public and statutory bodies.

Mr Steven says it was envisioned that through this mechanism, the Government could be able to access funds held by these bodies and redistribute the moneys to other areas of need.

He says even though the law is good in its intention, the process in which it was created was not followed.

The Ombudsman Commission took issue with the PMMR and challenged its validity where the Supreme Court on Wednesday made the declaration.

Mr Steven emphasized that all future Bills before approval by the Executive must receive wide consultation from relevant government agencies and not rushed through without having gone through legal and administrative processes in place,.
