PNG High Court rules in favour of Alternative Government

The Papua New Guinea Parliament Speaker Job Pomat's move to recall parliament on the 17th of December has been ruled unconstitutional by the country's high court. 


The five judges ruled  that the Speaker of Parliament Job Pomat's announcement and recall of Parliament on 17th of November,2020 was wrong and invalid and unconstitutional. It is contentious, calculated, deliberate and unlawful," They also ruled that Parliament Speaker Job Pomat acted unfairly and the passing of 2021 Budget is unconstitutional, invalid and ineffective.

The court found that : 

  • On issue of Namah breaching the Orgainic Law for adjournment, he did not breach the organic law.
  • The Parliament's adjournment to 01.12.20 was NOT unconstitutional.
  • recalling of Parliament is Unconstitutional and the purported passing of the Budget 2021 is unconstitutional.
  • Adjournment to 20.04.20 is also unconstitutional.
  •  The decisions made in that Parliament sitting on 13th November and decisions made then are not unconstitutional and valid and, consequently parliament sitting on 17th November and decisions made then are unconstitutional and invalid. 

Court orders  Parliament to be reconvened on 14th December, 2020
