Court Dismisses Second Case Filed by Former University of Goroka Interim Council
An application filed by the former Interim Council members of the University of Goroka, seeking leave for judicial review of a decision of the Minister for Higher Education, Research, Science and Technology, Wesley Raminai, in appointing new Council Members, has been dismissed by the National Court in Waigani.
Minister Raminai in a Gazettal Notice dated April 19th, 2021, revoked the appointment of Professor Joseph Sukwianomb as Chancellor of the Council of UOG and members of the Interim Council that he led.
New council members, to be headed by former MVIL Chief Executive Officer, Joe Wemin as Chancellor was then appointed.
The challenge by the former Interim Council members against Mr. Raminai's decision has been unsuccessful after the National Court yesterday dismissed the proceeding as there was no arguable case.
The Court ruled that the application does not demonstrate any arguable basis to bring this cause of action to fulfil that leave be accorded.
This was the second application after the initial application seeking leave for review was also dismissed for non-compliance with the National Court Rules on May 12th, 2021.
Meantime, the newly appointed Chancellor Mr. Joe Wemin together with new Council members of UOG welcome the court's decision yesterday.
UOG Chancellor Mr. Joe Wemin reiterates that the court case does not affect the operation of the university hence students learning will not be affected.
