PNG Court Grants Leave to Barrick Niugini Ltd to review Non Renewal of Mining Lease
The operator of the Porgera Gold Mine Barrick Niugini Limited in Papua New Guinea has been granted leave by the National Court in Waigani to have the National Executive Council's decision not to renew its Special Mining Lease reviewed.
Deputy Chief Justice, Ambeng Kandakasi made the ruling on Friday following an application filed by Barrick seeking leave to apply for judicial review of the NEC decision.
This means Barrick will now proceed with its legal challenge over the government's decision not to extend its mining lease as the operator of the Porgera Gold Mine.
The court ruled that Barrick has sufficiently pleaded its grounds for leave to be granted to challenge the decision.
Amongst the grounds, Barrick argued that the NEC did not provide any reasons as to why it made its decision not extend the mining lease and did not produce copies of the decision to Barrick.
Prime Minister James Marape on April 24 this year announced the Government's decision that it will not renew Barrick's mining lease based on recommendations of the Mining Advisory Committee.
Aggrieved by this decision, Barrick suspended its operations at the mine and commenced legal proceedings against the Government.
The application for review will be listed for hearing next month.
