Convicted MP Francis Potape seeks bail

Jailed Komo-Magarima M-P, Francis Potape, is seeking a Supreme Court bail, pending his judicial review application.
His lawyers presented their case this morning (Thursday 12 February), before a packed Waigaini Courtroom.
As Maivo Lafanama reports, Mr Potape appeared in person, looking his usual best.
Ian Molloy, the lawyer who successfully rescued Gulf Governor Havila Kavo from being in prison took up the case for the Komo Magarima MP.
Mr Molly argued four grounds of why the convicted M-P should be granted bail.
The grounds relate to prospect of success of the case at the Supreme Court, medical grounds of his client, errors by the trial judge in his ruling and his obligation as a member of parliament.
However, the State lawyer argued all this grounds doesn't amount to exceptional circumstances as to warrant a bail, and that Mr Potape has committed a serious offence abusing the trust of the office he holds .
A ruling is expected to be handed down tomorrow (Friday 13, Feb, 2015).
Mr Potape was sentence to five years imprisonment earlier this year, on one count of conspiracy and two counts of misappropriation of over 300-thousand Kina.
Half of the five year sentence has been suspended, with him to serve only two-and-half years.
Mr Potape has already filed an application at the Supreme Court, to review his sentencing.
