Papua New Guinea Deputy Opposition Leader Seeks Supreme Court Ruling on No Confidence Motion

 Papua New Guinea's Deputy Leader of the Opposition and Member for Chuave, Hon. James Nomane, has filed a legal challenge against the Private Business Committee (PBC) following its decision on 27 November 2024 to block a motion of no confidence against Prime Minister Hon. James Marape. Hon. Nomane argues that this action infringes upon MPs' constitutional rights to hold the executive accountable and represents a serious breach of the Constitution.

In addition, on the same day, Attorney General Hon. Pila Niningi proposed a bill to amend Section 145 of the Constitution, which would prevent any future votes of no confidence in the Prime Minister. Opposition MPs strongly opposed the bill, viewing it as an attempt to undermine democracy under the guise of promoting political stability. They argued that if the government was performing well, stability would naturally follow without the need for such restrictive measures.

In response, Hon. Nomane has sought Supreme Court intervention to compel the Speaker of Parliament to recall Parliament and allow the no-confidence motion to proceed. He has also filed an injunction to prevent Parliament from considering the proposed amendment to Section 145, calling the proposal an unjustifiable attempt to further shield the Prime Minister from accountability.

Hon. Nomane emphasized that his legal actions are undertaken on behalf of the people of Chuave, Simbu, and all Papua New Guineans. He called on all Members of Parliament to unite in defense of the Constitution and against laws that would consolidate power within the executive. He argued that these actions threaten democratic values and undermine the rights of MPs to challenge the government.

Criticizing the Marape government's record, Hon. Nomane described the administration as weak, indecisive, and ineffective, pointing to persistent issues such as law and order, inadequate healthcare, poor education standards, and high unemployment. He stressed that prudent leadership is essential to address these challenges and restore PNG's socio-economic stability.

Looking ahead to 2025, Hon. Nomane urged MPs to prioritize the Constitution and the future of the nation, calling for a leadership change through a vote of no confidence to offer hope for a better future for Papua New Guinea.
