Appeal by Police Commissioner Gary Baki dismissed
An appeal by Gari Baki on a judicial review on the suspension of Thomas Eluh and the termination of Timothy Gitua at the Supreme Court was dismissed by Judge Ere Kariko this morning.
Mr Baki appealed on ground that the trial judge over looked administrative procedures in handling disciplinary issues before going ahead to grant a judicial review.
The appeal also requested for Mr Baki to review his decision but Judge Kariko said the Police Commissioner makes the final decision and that decision cannot be reviewed unless the decision came from a officer in the lower rank. Meanwhile, the substantive matter is still before the National Court.
