PNG High Court dismisses Opposition Leader Namah's challege against PM James Marape
The Papua New Guinea Supreme Court this afternoon dismissed the proceedings filed by Opposition Leader Belden Namah challenging the legality of the election of Prime Minister James Marape in Parliament last May.
Prime Minister Marape, through his lawyers, had objected to the competency of the application by Mr Namah on four grounds.
The Supreme Court dismissed three of the grounds.
The fourth ground that the high court upheld was that the application used an incorrect file reference and was incorrectly filed as a ‘Reference’ rather than an ‘Application’ therefore not complying with the Supreme Court rules.
Deputy Chief Justice Ambeng Kandakasi, Justice David Cannings and Justice Jeffrey Leonard Shepherd ruled therefore the proceedings are fatally flawed and the application is incompetent.
The three-judge bench ruled that the incorrect and confusing description of the proceedings as a Reference renders the application incompetent which means that the proceedings must be entirely dismissed.
Meanwhile, outside the court house, Mr Namah told reporters that he is not done.
Mr Namah says he will sit with his lawyers and discuss his next course of action.
